WARRANTY, INSPECTION, TESTS AND CANCELLATION TERMS & CONDITIONS

 

1.1 The Supplier warrants that as from the date of despatch for a period of 1 YEAR the goods and all their component parts, where applicable, are free from any defects in design, workmanship, construction or materials.

The return of Goods to the Supplier shall be at the responsibility and cost of the Customer.

No return of goods shall be accepted by the Supplier without a Return Material Authorisation (“RMA”), which may be issued by the Supplier or the Supplier’s supplier in their sole discretion. A request to return goods because of visible defects must be made within one week of receipt. A request to return goods because of hidden defects must be made within one week of discovery and in any case not later than 12 months as of receipt thereof. Customer shall lose the right to return goods when he misses to timely send the requests as set out in this paragraph. Returned goods must be in original manufacturer’s shipping cartons complete with all packing materials. All goods for return shall be returned freight prepaid in the manner specified in the RMA. If returned goods are claimed to be defective, a complete description of the nature of the defect, as well as the date and the circumstances of its discovery must be included with the returned goods. If the Supplier consents to a return or cancellation of goods that are not subject to warranty claims, it reserves the right to make return or cancellation charges, including those charges specified in the RMA.

Other than the foregoing guarantee, no liability will be accepted by the Supplier for any damage or loss, consequential or otherwise, due to supply, offer to supply or failure to supply, or otherwise in connection with, any Goods or services or failure to advise or ensure the fitness for the purpose of any Goods or service or information that shall be provided by the Supplier, or the use or misuse of such by the Customer

The foregoing guarantee shall be void in the event that any modification or repair or misuse of the Goods has been made whether by the Customer or by a third party.

 

1.2 The Supplier warrants that the services performed under this Agreement shall be performed using reasonable skill and care, and of a quality conforming to generally accepted industry standards and practices.

 

1.3 Except as expressly stated in this Agreement, all warranties whether express or implied, by operation of law or otherwise, are hereby excluded in relation to the goods and services to be provided by the Supplier.

 

1.4 The Products are carefully inspected and where practicable submitted to the Supplier’s standard tests at its works before despatch. If tests other than those specified in the Specification Document or tests in the presence of the Customer or its representative are required these may be charged for at the Supplier’s option. In the event of any delay on the Customer’s parts in attending such tests after seven (7) days’ notice that the Supplier is ready to conduct the same the tests will proceed in the Customer’s absence and shall be deemed to have been made in the Customer’s presence.
